FCA Investigations and Enforcement
FCA Investigations and Enforcement
The Financial Conduct Authority (FCA), previously the Financial Services Authority (FSA), came into being on 1st April 2013 and has extensive powers to investigate and prosecute suspected misconduct. Our expert regulatory lawyers have extensive experience in advising individuals facing FCA investigations or prosecutions.
We regularly advise upon all aspects of civil and criminal proceedings and regulatory enforcement action brought by the FCA. Our expertise ranges from criminal allegations, such as insider dealing and making misleading statements to the market, to regulatory breaches of the FCA's Principles for Businesses and Approved Persons.
We assist individuals at every stage of the process, including:
- dealing with compulsory requests for information and documents;
- advising and attending interviews with the FCA; and
- advising upon a requirement to appoint a Skilled Person under s.166 or s. 166A Financial Services and Markets Act 2000.
