Inheritance considerations

Before you buy a property in Spain the form of ownership should be taken into consideration. All real property in Spain is always subject to Spanish inheritance tax and the tax rate can be as high as 60%.

English law will usually apply to the succession of an English national who has property in Spain, however, this is an area for debate, and in some cases, the Spanish courts have applied Spanish law to distribute a deceased's assets. This should therefore be reviewed at the earliest stage possible.

Wills and Probate

Property owners should deal with their Spanish assets in an English Will or Codicil or a Spanish Will. We can advise on which may be the most suitable, depending on the testator's personal circumstances. This helps to avoid complications regarding the particular law that will apply to the succession.

Should the deceased die intestate, with neither a Spanish nor English Will dealing with his assets in Spain, then Spanish law may be the relevant law and could apply the Spanish compulsory heirs' rules. We can advise you on the best option for your circumstances, drafting suitable Wills and or Codicils.

We can assist in the probate process in Spain and deal with this in conjunction with the administration of the UK and worldwide estate. If there is an English or Spanish Will dealing with the deceased's assets in Spain we will carry out the necessary formalities through the English and Spanish probate registries to allow the Will to be validly accepted in Spain.

An affidavit or certificate of law regarding the English legal system and / or law may be required by the Notario or land registry in Spain and we can prepare such documents where required.

We can prepare bilingual documents for you in the UK which can then be executed in the presence of a notary public, notarised and legalised. This is a service which we offer in-house with our own public notary. Alternatively, we can provide you with the details of a notary closer to your own vicinity. We also deal with the Foreign & Commonwealth Office in order to obtain the apostille (legalisation certificate), facilitating and progressing the process as quickly as possible.

NIE or CIF (ID numbers)

We can assist non-residents to obtain a Spanish fiscal identification number, personal or company, essential to enable you to buy property and pay tax in Spain within a fixed period of time, thus avoiding late payment penalties. We can also assist with obtaining an extension to this time limit from the Spanish tax authorities in certain cases.
