Funding Your Claim

What will your industrial disease claim cost?

At Pannone we offer a free initial no obligation consultation. If we are able to assist with your claim we will make sure that the claim does not cost you a penny. There are various ways to fund your claim:

  • legal expenses insurance
It is unusual for policies such as home insurance to cover industrial disease claims but occasionally they will cover the costs of your claim. If your existing insurance does not cover the claim, we will enter into a 'no win, no fee' agreement with you.
  • membership legal assistance
This applies if you are a member of a trade union, a membership organisation or a friendly society.
  • 'no win, no fee' agreement
The most common way these claims are funded is through a 'no win, no fee' agreement. This means that if your claim failed you would not have to pay us anything.

To take account of the risk of entering into a ‘no win no fee’ lawyers claim what is known as a ‘success fee’ if the claim is successful.  The ‘success fee’ is paid by the Defendant or their insurers not by you.

ATE Insurance

The law states that if the case is lost, the losing party pays the legal costs.  To ensure you are not left with any bill to pay, we take out what is known as an ‘after the event’ or ATE insurance policy on your behalf.  The cost of the ATE insurance is deferred until the end of the case.  If you win your case the Defendant pays for the ATE insurance.  If you lose your case no payment is required as the policy is ‘self-insured’ and so will pay off the premium and any costs of the Defendants, court costs or other ‘disbursements’ such as medical report fees.

Our ‘no win no fee’ service is completely free to you.
