When can a child be removed from England and Wales?
A child under 16 can only be removed from England and Wales lawfully with the consent of everyone who holds parental responsibility for the child, or by an order of the court.
If a residence order is in force then the person in whose favour the residence order is made may take the child out of the UK for up to 28 days without consent.
To remove a child from the UK without permission may be a criminal offence and likely to be classed as child abduction.
