Funding Your Clinical Negligence Claim

We offer a number of schemes to fund clinical negligence claims. We have a Legal Services Commission Clinical Negligence Franchise. We have won many cases for clients using Conditional Fee Agreements. The bottom line is that if you have a good claim, we will find a way of letting you pursue it.

Some of the schemes we use to help people claim include:

Public Funding (formerly Legal Aid)
Only a limited number of firms have been granted a franchise by the Legal Services Commission. Our franchise means that we are able to assist clients who are financially eligible and who have a potential case on a Publicly Funded basis. Please contact us to discuss whether you may be eligible for Public Funding.

Legal Expense Insurance
Many people have Legal Expense Insurance attached to their household insurance policy. Check your policy for details. It is usually necessary that cover was actually in place at the date of the negligent treatment. Not all policies cover clinical negligence cases. Many policies have strict time limits on how quickly requests for assistance must be made so do not delay in contacting us and we will provide guidance on contacting your insurer.

Conditional Fee Agreement
In many cases we will enter into a Conditional Fee Agreement which would cover our fees for investigating and pursuing your claim. This means that if the case is not successful we do not charge you for our fees. If necessary we can make arrangements so that you do not have to pay any money up front for either our costs or fees for medical experts. Conditional Fee Agreements are complex, please contact us to discuss your individual circumstances.

Private Funding
If none of the options above are available you can pay us to investigate your case. We will give you a clear estimate at the outset and, if you wish, agree with you limits for each stage of the investigation. We can set up a standing order to allow you to budget more easily if you prefer.
