Personal Injury Case WinsJoanne Berry Post Traumatic Stress Disorder Won: £225,000Joanne achieved settlement for Mr W at a Joint Settlement meeting, following a road traffic accident which caused back injuries and Post Traumatic Stress Disorder compounded by depression. Mr W’s Psychiatric expert confirmed the condition heightened his perception of pain and lessened his capacity to deal with it, and he was wheelchair bound as a result. The Defendants experts argued Mr W had sustained only soft tissue injuries and his ongoing complaints were either as a result of exaggeration or alternatively a long standing disorder unrelated to the accident. Richard Scorer – Road traffic accident settlement Won: £5,500,000In 2009 Richard Scorer settled a claim for £5.5 million on behalf of a 26 year old man from Blackburn who suffered devastating brain injuries in an RTA. The claim was against the MIB and was settled on the basis of 87.5% liability. Carol Brooks Johnson - Road traffic accident settlement Won: £3,000,000In 2009 Carol settled a case for a child, RC, one day away from her 5th birthday when she was knocked down on a pedestrian crossing. She suffered very serious injuries including a brain injury from which she has not recovered. Who was to blame for the accident was disputed and Carol pursued the case to court. It was agreed that RC would receive two thirds of the value of her claim. When it came to valuing her claim this was agreed at £4.5 million and so RC received £3 million. As RC was still a child most of her monies were invested on her behalf. She has had access to some of the monies now for things that she needs. The bulk of her money will gain interest until she needs to use the same. Carol Brooks Johnson - Glider accident Won: £2,500,000In 2009 IT was a co-pilot in a glider when it crash landed. He suffered very serious spinal injuries. He will not work again. He will need care and assistance and adapted accommodation. Carol alleged that the pilot was to blame. This was contested. Finally, after court proceedings, it was agreed that the pilot was 90% to blame for the accident so IT would receive 90% of the total value of his compensation. IT was awarded £2.5 million (being 90%) to compensate him for his injuries and losses. Richard Scorer - Road traffic accident settlement Won: £1,920,000In January 2010 Richard Scorer settled a claim for £1.92 million on behalf of a man who suffered serious brain injuries in a road traffic accident in Nov 2006. The man is a protected party, and the money will be used to provide for his future needs including his care. Catherine Leech - Road traffic accident settlement Won: £1,000,000In 2010 Catherine Leech agreed a settlement for claimant injured in a road traffic accident who has suffered moderate brain, orthopaedic and eyesight injury. After deduction for contributory negligence the claimant will receive £1,000,000 damages. This case was settled at a Joint Settlement Meeting in advance of a trial listed for June. Pauline Chandler – Peritoneal mesothelioma Won: £350,000Pauline settled a very unusual peritoneal mesothelioma case (as opposed to the usual pleural mesothelioma) for £350,000. The claimant had developed the condition from washing her husband’s clothes when he worked on fishing boats. Deirdre Healy - Periodical payment settlement Won: £595,000In March 2010 Deirdre agreed settlement for a client who sustained catastrophic brain injuries as a result of a road traffic accident, when he was crossing the road as a pedestrian. The settlement involves a lump sum of £350,000.00 with annual payments of £22,000 to provide for the client‘s care and case management needs. The settlement was approved by the Court as the client is a protected party as a result of his head injuries. Pauline Chandler – Mesothelioma Won: £280,000Pauline secured an award of £280,000 for a widow whose husband died of mesothelioma in 1992 and whose original solicitors had been unable to find the defendant insurers. Pauline has enjoyed an increasing number of instructions from clients who have been told, erroneously, by other solicitors that they have no claim either due to limitation reasons, or because of difficulties in locating the defendant insure, or apparently poor prospects. Richard Scorer– MOD PTSD Won: £265,000In January 2010 Richard settled a claim for a former soldier who developed severe PTSD as a result of his active service within the army, and was then not treated appropriately by the army’s medics. Settlement was agreed at £265,000.00 to take into account his loss of earnings and pain, suffering and loss of amenity. Daniel Radiven and Joanne Berry - Fatal accident Won: £250,000In 2009 we achieved a settlement of £250,000 for the family of Mr R, who sustained injuries in a road traffic accident and later sadly died from those injuries. The case was unusual as the accident caused a worsening of the clients pre existing kidney disease, and we argued the accident caused his untimely death relying on evidence from a nephrologist. The settlement will provide for the family of Mr R, who left young children. Paul McClorry - Holiday illness settlement Won: £240,000In 2010 Paul McClorry settled a substantial claim for damages for his client Beryl Rushton. Beryl sustaining serious gastrointestinal symptoms and fibromyalgia as a result of a bacterial infection sustained whilst on holiday in the Dominican Republic. She has been left with long term impairments, and relies on crutches and a mobility scooter. Paul agreed a settlement of £240,000.00 believed to be the highest ever payout by a tour operator for a holiday illness claim. Richard Scorer - CICA appeal Won: £210,000Richard Scorer successfully represented a client at a Criminal Injuries appeal in April 2010. Our client, a corner shop owner from South London, was blinded in one eye after trying to pursue a group of youths who were stealing from his shop. The CICA‘s original award was £71,000 and Richard managed to get this increased to £210,000 at the appeal hearing. The appeals panel also accepted that the award should not be reduced as a result of the fact that our client had pursued the youths with an iron bar. Patrick Walsh – Mesothelioma Won: £200,000Patrick settled a mesothelioma case for widow of man who served in Royal Navy and was exposed to asbestos dust. The client also visited the premises of 2 shipyards whilst in the navy and was present whilst asbestos lagging installed on submarines. No claim was possible against the navy because of Crown immunity but Patrick secured a £200,000 settlement against the shipyard for breach of Factories Act 1961. Patrick Walsh – Lung condition Won: £150,000Patrick settled a claim for a man who had originally been diagnosed with a constitutional lung condition in 1996. In 2005 his new treating doctor changed the diagnosis to silicosis caused by his work in a chemical mixing plant. The case settled a week before trial for £150,000- the defendants still maintaining that his condition was constitutional. Joanne Berry - Filtering motorcyclist Won: £113,000In February 2010 Joanne agreed a settlement of £113,000.00 for a 61 year old motorcyclist. IC was injured when riding on his motorcycle, filtering past stationary traffic when he was hit by a car that emerged from a side street to his left. Despite contributory negligence arguments we achieved a settlement in full. IC sustained orthopaedic injuries and the settlement provides for his loss of earnings, injuries and treatment. Deirdre Healy - Settlement for pedestrian Won: £105,000In 2009 Deirdre achieved a settlement of £105,000.00 for CW, who was struck by an motorcyclist whilst crossing the road outside her home. The motorcyclist and pillion rider both died. CW sustained multiple lacerations, orthopaedic injuries, A DVT and psychological symptoms. Deirdre achieved a negotiated settlement of £105,000.00 from the Motor Insurers Bureau because the motorcyclist was uninsured. Carol Brooks Johnson - Fatal accident settlement Won: £60,000Mr and Mrs H had one son. One night whilst they were out walking they heard the sound of a road traffic accident. Upon going to see if they could help they discovered that their son had been very badly injured and he subsequently died. A claim was brought against the other driver involved in the crash. A claim was made on behalf of the son‘s estate. A claim was made in respect of a dependency the parents had on the son. A claim was made for the psychiatric injury the parents suffered as a result of witnessing the aftermath of the collision and the death of their son. Following the issue of proceedings the matter settled in 2009 for £60,000.00. Carol Brooks-Johnson - Pedestrian liability settlementIn March 2010 Carol Brooks-Johnson finalised a difficult road traffic accident liability case. On a very cold and icy Boxing Day night the Claimant stepped into the path of a taxi, was hit and sustained a significant head injury. The evidence was that given the treacherous weather conditions the taxi was going too fast at 20 miles per hour and should have been going much slower. Settlement was approved on a 60/40 basis in favour of the Claimant. Carol Jackson - Liability success at trialCarol recently obtained an excellent outcome following a complex 3 day trial for R, who was struck by a car whilst acting as a volunteer for a media bus, on a project run jointly by her school and a church charity organisation. We sued the driver of the vehicle that struck R and also the driver of the media bus, the school and the charity jointly for their failure to devise a safe system for their volunteers, and their respective insurers. The Judge decided that the driver of the car was 50% to blame, the school and the driver of the mini bus 35% and the charity 35%. The claimant was herself 15% contributory negligent.
