Property litigation

The department's Property Litigation team consists of commercial litigators with specialist property litigation experience. The team provides cost effective advice and assistance for a wide range of clients involved in property disputes including companies, partnerships and individuals. It deals with all aspects of property litigation and alternative dispute resolution including negotiation, mediation and arbitration.

The team has extensive experience advising in the management of commercial property portfolios, for both landlords and tenants. We deal with the usual range of landlord and tenant disputes including renewals under the 1954 Act, dilapidations disputes, forfeiture and recovery of possession, and recovery of rent by action or distress.

The team also advises on disputes involving wider property issues such as complex boundary and right of way disputes, contractual and development issues including breach of covenant claims, "nuisance" claims, possession proceedings against trespassers, cohabitation disputes and professional negligence claims arising out of property transactions.

Our team of property litigation lawyers also work closely with the Commercial Property department where our different areas of expertise overlap. This ensures that our clients receive a seamless and comprehensive service covering all the requirements of their particular business.

Our experience

Our recent experience includes:

  • Acting successfully for a North West passenger transport executive in a substantial arbitration relating to the interpretation and effect of a private Act of Parliament, in connection with a compulsory purchase order.
  • Acting for a number of household names in the management of their property portfolios of tenanted properties throughout the UK.
  • Acting for a major house-builder in a substantial claim relating to sales of units in the largest residential development in the UK. The claim was successfully settled shortly after a mediation.
  • Acting for a number of developers on claims arising from the interference with rights of light.
