Intellectual property

The dedicated contentious Intellectual Property team of solicitors at Pannone LLP advises companies, including design and software companies, designers and individuals on the protection of their intellectual property rights and in defending claims made against them.

Our experience

Our experience includes:

  • Defending a number of large independent software companies in substantial legal actions brought by Microsoft Corporation for parallel importing.
  • Successfully acting for the defendant company in Nike and RFU v Cotton Traders Ltd, resulting in the revocation of most of the RFU's trade marks of the red rose of England and defining the law as to what third party rights can subsist in national emblems.
  • Acting for the defendant in an appeal to the High Court of the decision of the Trade Mark Registry in Scoredraw Ltd v The Old Fashioned Football Shirt Co Ltd relating to the rights in the badge of the Brazilian Football Association.
  • Acting for the claimant on the assessment of damages due to it following a successful patent and design right infringement action brought by it against a competitor. Not only were substantial damages recovered for our client together with a significant interim costs award but the decision also set an important precedent in intellectual property law.
  • Acting in numerous domain name dispute cases, some involving well known brands.

The Intellectual Property team of solicitors is led by Bill Lister, who is in addition a CEDR Accredited Mediator, and is a leader in his field (The Chambers Guide to the Legal Profession). Other members of the team include partners Paul Jonson and Melanie McGuirk, and associate Andrew Vickerstaff, all of whom have been awarded a Postgraduate Diploma in Commercial Intellectual Property Law.
