Insolvency

Insolvency presents a crisis but it can also provide opportunities. Representing parties on both sides of this double-edged situation, the Commercial Litigation department at Pannone LLP has the all-round experience necessary to achieve the best possible outcome for our clients when insolvency-related disputes arise. Our team is dedicated to devising strategies that achieve this, with an emphasis on rescue, recovery and renewal wherever possible.

Our expertise covers the full spectrum of formal and informal insolvency regimes including:

  • Administrations.
  • Receiverships.
  • Liquidations.
  • Company Voluntary Arrangements.
  • Company re-structures and re-financing.
  • Creditors' rights on insolvency.
  • Claims against directors.
  • Directors' disqualification.
  • Landlords' rights on insolvency.
  • Bankruptcy.
  • Individual Voluntary Arrangements (IVA).

Our experience

Our experience includes:

  • Acting for the former finance director of a large corporate in defending director's disqualification proceedings.
  • Acting for a creditor in the receivership of a large retail group in circumstances where a competing creditor was claiming to be entitled to the majority of the surplus assets in the insolvency. We successfully secured a payment which represented a significant proportion of the surplus for our client.
  • Acting in connection with a multi-million pound claim for breach of contract arising from the administration of a national retail chain.
