Military criminal injury claims

When military personnel are assaulted, whether by an individual outside the armed services or a colleague, it is possible to make a military criminal injury compensation claim against either the MOD, or under the Criminal Injuries Compensation Authority (CICA).

Making military criminal injury claims

If a military serviceman or woman is assaulted during the course of duty, it is possible that a claim could be brought against the MOD based on their vicarious liability for the actions of their employees. If the assault is carried out by someone from outside the armed services, a claim may be possible under the criminal injuries compensation scheme.

If you sustained your military criminal injury in the UK or its territorial waters, a claim will typically be made under the Criminal Injuries Compensation Authority (CICA) Scheme 2001. However, where service personnel are injured as a result of a crime of violence occurring overseas, a claim may be possible under the MOD (Overseas) CICA Scheme, which exists specifically for service personnel.

Making a claim against the MOD

Many Armed Services personnel are understandably concerned about the possible repercussions of making a claim, particularly if they are still in the employment of the MOD.

As with all compensation claims, military assault claims are subject to a time limit. Claims of negligence against the MOD as an employer are subject to a standard three year time limit from the date of the accident. However, claims to the CICA must be made within two years of the assault. Certain claims against the MOD in respect of assaults committed by service personnel may attract a time limit of six years, but this is very strict and you should seek advice as soon as possible after the incident.
