Military injury claims: accident on a training exercise

Making a claim for military accident compensation

If you have been injured during a military training exercise and wish to make a compensation claim, you will be required to demonstrate that negligence or a breach of duty on the part of the MOD is directly responsible for the accident that caused your injuries.

This may mean that the accident was caused by the negligence of the MOD employee supervising the training exercise, or it may mean that you, or another individual taking part in the training exercise, were supplied with defective equipment.

If you are able to prove that the MOD is responsible for the accident which caused your military injury, it is highly likely that your military injury claim will be successful.

Making a claim against the MOD

Many Armed Services personnel are understandably concerned about the possible repercussions of making a military injury claim, particularly if they are still in the employment of the MOD.

As with all compensation claims, military training accident claims are subject to a time limit. Claims of negligence against the MOD are subject to a standard three year time limit from the date of the accident. However, for claims made under the Armed Forces Compensation Scheme, there is a limit of five years from either the date of the original accident or the date medical advice was first sought.
