Our clients' baby died following a breech delivery
Our clients made a claim for damages following the death of their son, baby A, who died following a breech delivery. It was alleged that midwifery and medical staff at the Defendant Hospital failed to appropriately manage the delivery of baby A.
Baby A was our clients’ first child and after admission to hospital the labour was progressing well but the breech presentation was only recognised at the time of delivery. Delivery of a breech presentation is an obstetric emergency but the consultant obstetrician was not contacted and baby A’s birth was left to be managed by midwives and an obstetric registrar who had only been in post at the trust for five days.
After baby A’s body was delivered his head became stuck. Certain manoeuvres and procedures could have been carried out to deliver him sooner than he was but these were not undertaken. This resulted in baby A’s head not being delivered until 15 minutes after his body during which time his oxygen supply was cut off. By the time he was born he was in such a poor condition that, despite resuscitation, he sadly died.
Tragically, unconnected to the above events, less that 12 months later our clients’ lost their second son, baby R, who was born prematurely and he didn’t survive.
We represented baby A’s parents at the inquest into baby A’s death in April 2009 where a narrative verdict was delivered, identifying failings in the standard of care, linked to baby A’s death.
Baby A’s parents were devastated by their loss but through the inquest process and by bringing their claim they received the answers they deserved to their burning questions about the care that they received. Settlement of the claim was agreed in the sum of £135,000 in June 2010.
