Our client sustained erbs palsy following negligent management of shoulder dystocia
We acted for a client who sustained injury during the course of delivery. Following a difficult labour, forceps were used and our client’s head was delivered. However, a shoulder dystocia was then noted before our client was eventually delivered by firm downward traction.
We proceeded with an investigation together with a report from a consultant occupational therapist on our client’s future needs and settlement was achieved without the need for court proceedings. The money will be used to minimise the impact of the brachial plexus injury on her life.
It was alleged that the management of the shoulder dystocia and delivery of the baby amounted to negligent care, causing her to suffer an injury to her brachial plexus, diagnosed as erbs palsy.
