How long will my cancer compensation claim take?

It can take some time to complete a work related cancer compensation claim because:

  • we have to prove that your condition was caused by exposure to something at work rather than by smoking, drugs or exposure elsewhere. The evidence gathering process can therefore take time
  • if the company that exposed you to hazardous substances has stopped trading, we have to find their employers liability insurers at the time when you were employed there. This is not always possible
  • we have to prove your employers were negligent in letting you work in potentially dangerous conditions

Time limits in making a claim

There are time limits for bringing such claims. Basically you will have three years from the date when you were first diagnosed with a work related illness and if legal action is not started within that three year time limit, you may not be able to pursue your claim at all.

If you think your cancer is work related it is therefore important that you mention it to your GP as soon as possible and ask whether there is likely to be any connection with your work. If so, you should also then consult a specialist lawyer.
