Turner and Newall Scheme Claims

What is the Turner & Newall’s Scheme?
If you have been diagnosed with an asbestos related illness and were employed by Turner & Newall, T & N, Turner Brother Asbestos, Everites, JW Roberts or any other Turner & Newall group company, you must make your claim for compensation under the Turner & Newall’s Scheme.
Even if you did not work at a Turner & Newall company, but you were exposed to asbestos through their activities or at their premises, then you also may be entitled to make a claim, for example, exposure to asbestos from overalls of a Turner & Newall employee or contractors who worked in Turner & Newall factories.
As the Turner & Newall group of companies went into administration in 2001, they can no longer be sued directly. A scheme of arrangement was created so that people exposed to asbestos by the companies could still recover compensation if they were diagnosed with an asbestos related illness, such as:-
Claims are to be submitted and are then decided by the Trustees of the Scheme or an Independent Arbitrator. They are settled without the need for court proceedings; however, certain criteria must be met to qualify for a payment.
The workings of the T and N Scheme are very complex and Pannone has been pursuing claims under the Scheme since it started in October 2006. As a result, we have developed expertise in obtaining the best results for sufferers of asbestos related conditions.
What are the Turner & Newall’s Scheme Criteria?
- The claim must be made within three years from the date you were diagnosed with an asbestos related illness. In the case where someone has died of an asbestos related illness, the claim must be brought on their behalf within 3 years of the date of their death.
- There has to be 'credible evidence' of asbestos exposure. Claims for asbestosis or lung cancer also need at least six months employment with a Turner & Newall company.
What awards of Compensation are available under the Scheme?
The Scheme prescribes different awards depending on the asbestos related illness from which you are suffering.
As the Turner & Newall group of companies are in Administration, generally you cannot recover the full value of your claim as the Scheme can only pay you a certain number of pence in the pound. Despite this, the awards are still significant.
Some of our past asbestos settlements include:
- £92,000 for a widow who lost her husband to lung cancer
- £95,000 for a lady who was suffering from mesothelioma
- £121,000 for a widow who lost her husband to mesothelioma
- £198,000 for a man who was suffering from mesothelioma due to only having worked 12 months or less with Turner Brothers Asbestos in Rochdale
- £25,000 for a gentleman suffering from asbestosis
- £15,000 for the daughter of a lady aged 98 who died from mesothelioma who had been exposed to asbestos through her husband’s overalls. He had worked for Turners Asbestos Cement in Trafford Park
