Every year tens of thousands of UK holidaymakers choose to take a cruise line holiday and this is a trend that is set to increase. With this growth comes a demand for specialist legal advice in food poisoning and accident compensation claims. At Pannone we have a team of personal injury solicitors that specialise in travel litigation and they have successfully handled cruise ship compensation claims for many years.
Cruise ship holiday claims
Many cruise ship holidays bought in the UK will be covered by the Package Travel Regulations 1992 which regulate the liability of the holiday organiser for any accident, personal injury, food poisoning or the outbreak of a virus. This is an important set of rights for the holidaymaker but the courts have allowed cruise lines to qualify their obligations with reference to International Conventions.
By its nature much of the cruise line industry operates in international waters or within the jurisdiction of several countries during a voyage. An important international convention called the Athens Convention covers many countries (including the UK) and sets up a regime for dealing with compensation claims brought by cruise ship passengers. Where applicable this regime does require that fault or negligence is proved by the passenger against the carrier but for certain types of accident this burden of proof is shifted to the cruise line operator.
There are some important differences in cruise line compensation claims that require a specialist legal approach. The issue of which countries' courts have jurisdiction to hear a case is often complex and time limits for taking action can be surprisingly short-especially in actions against USA based carriers. The internet means that UK tourists are now often booking direct with foreign cruise lines without fully understanding the consequences of the contract terms if things go wrong.
Here are some examples of cruise ship compensation claims that our personal injury solicitors have handled for passengers:
- Herald of Free Enterprise / Zeebrugge disaster
- Marchioness disaster
- US Cruise Line food poisoning outbreak
- Turkish pleasure cruise fire
