All public bodies must act within their powers and in a fair and reasonable way when dealing with you, any problems you may have and your access to public services of any kind for which they are responsible.
All public bodies must always reach fair, rational and reasonable decisions about you, your rights and entitlement to public services.
Public bodies must always act in accordance within what are known as public law principles, perhaps most easily described as duties to act fairly, reasonably and rationally when making decisions. Any failure by a public body to act in such a way or, as is often the case, actually reach a decision as to your rights and entitlements, can, and in our view should, be challenged; either by negotiation, argument, complaint or by Judicial Review proceedings.
Judicial Review
Judicial Review proceedings are a means of challenging the decisions of public bodies on the basis that the decision making process adopted by them is so seriously flawed as to be unlawful in accordance with public law principles and / or your human rights.
