It is always important to recognise that a person may need a wide range of care services. Often, this will be a mix of community care, healthcare and what are known as continuing healthcare services.

All too often your healthcare needs and social problems are underestimated or ignored and  you may not receive the full package of care and support services you need to enable you to live as independent a life as possible.

We can ensure you not only receive the healthcare, continuing healthcare and public services you need; what are known as ‘primary’ health care services (for example access to a GP, hospital treatment) but also continuing healthcare services when you are discharged from hospital or when you are living in the community with a continuing need for health or nursing care. This is traditionally what is known as continuing healthcare.

Sadly, those responsible for providing primary, secondary and continuing healthcare in your area often do not properly assess your needs, or unfairly restrict healthcare services leading to a breakdown in care services for you in the community.

We can help you argue that you need continuing healthcare when the Primary Care Trust unfairly and unreasonably decides that you do not need healthcare but instead need community or social care services.

Delayed Discharge

We believe it is always important to help those who have suffered profound and serious injuries long before, and certainly at, the point when they are to be discharged from hospital: at which point not only will you often be having to deal with life changing injuries but probably the difficulties of rehabilitation and moving back into the community.

We can help get the full package of care services you need, deal with any delayed discharge from hospital and ensure that full discharge planning is undertaken by the Primary Care Trust and / or the local authority and that you are not, for example, simply discharged into an inappropriate and inadequate residential placement.

Any failure to properly assess care needs, of any type, or any failure to provide appropriate care services or limit services, often on the basis of restricted budgets, can, and in our view should, be challenged. 

We can help you challenge such decisions, or failure to make such decisions, by way of negotiation or argument, formal complaint or in circumstances when the Primary Care Trust or local authority is acting unreasonably, irrationally and unlawfully, by way of Judicial Review proceedings in the Administrative Court.
