Personal injury compensation trusts

If you claim means-tested benefits, such as Income Support, Housing Benefit, and Council Tax Benefit, any payment you receive in compensation for a personal injury may affect your entitlement if it is not paid into a personal injury compensation trust.

We can help you maintain your entitlement to means-tested benefits by creating a Compensation Protection Trust (also known as a Personal Injury Trust or a Special Needs Trust).

Under the current rules, any payment in respect of a personal injury that is held in a Compensation Protection Trust is completely disregarded when assessing your entitlement to means-tested benefits.  This allows you to use your compensation as it was intended, and not simply as a substitute for your means-tested benefits.

Our solicitors will:

  • provide you with detailed information about Compensation Protection Trusts
  • prepare a Compensation Protection Trust specifically suited to your personal circumstances
  • explain the main provisions of the Trust and store the Trust Deed for you
  • write to your benefits offices to explain why your compensation is disregarded when assessing your entitlement to means-tested benefits

In high value claims or in cases where a child is involved you may wish to have a professional trustee appointed. We have extensive experience of working with those who have received compensation to manage their funds effectively and to maximise the advantage of the compensation by providing professional advice and support.
