Elderly Clients & Powers of Attorney

As the population ages, more and more people find themselves in need of specialist and comprehensive advice on how to deal with the often complex and challenging legal issues which affect older people and their families.

Whether you are planning for your own future, or whether you are worried about a loved one, our sympathetic elderley law specialists have the experience and the know how to help.

Powers of Attorney / Lasting Powers of Attorney

We firmly believe that all adults should plan for the future by putting into place Lasting Powers of Attorney. Since 2007 you can now name someone you trust to have permission to help you make future decisions by signing a Lasting Power of Attorney.

You can plan for every eventuality by making Lasting Powers of Attorney to cover medical and welfare decisions as well as financial and legal issues.  Some people use Lasting Powers of Attorney as a safeguard for the future, to ensure that their religious or moral beliefs about end of life treatment are upheld. Others may simply wish to have the peace of mind of knowing that the people they are closest to will be able to keep on top of their financial matters should they face illness or incapacity in the future.

Problems with mental capacity

What happens when someone you care about has impaired mental capacity, and has not planned for the future by making a Power of Attorney?

Who can help them manage their bills, deal with their pension, file their tax return, or look after their savings and check they are getting a decent rate of interest?  If they have not made a Power of Attorney, the only way to have the legal standing to help is to apply to the Court of Protection to become their deputy, or for a professional deputy to be appointed.

Moving into care

The move into residential or nursing care can be a stressful and challenging time.  From worries about whether the right decision has been made to concerns over what the home will be like, and how the care will be paid for, it often helps to take specialist advice from people who know the issues inside out.

If you are concerned about a loved one moving into care, why not talk to one of our specialists to see how we can help you with the transition.
