Disputes in the Court of Protection

 

 

Sometimes, disputes about finances or welfare for people lacking capacity can come before the Court of Protection.  Such proceedings are complicated and require detailed knowledge of the intricacies of the Court of Protection’s practice and procedure.   

We can assist with such proceedings, whether it relates to making an application to the Court that may cause a dispute with a family or to oppose an application that is not considered to be in the best interests of the individual concerned.   We will actively try to negotiate an agreement or settlement to avoid the costs of litigation but are fully prepared to attend hearings before the Court of Protection should it be in the best interests of the client to do so. 

Some examples of our recent Court of Protection work include:

  • successfully acting for a lay deputy in respect of a contentious lifetime gift opposed by other family members
  • a dispute concerning an elderly lady regarding where she should reside
  • a contentious statutory Will application for an estate worth several million pounds
  • successfully claiming against a lay deputy’s security bond in respect of a default that caused a significant loss to the protected party
  • objecting to the registration of a lasting Power of Attorney
