The Enforcement Division of the FSA has been sharpening its teeth and working hard to become a "credible deterrent" against market abuse in the City.
The drive to reduce financial crime has increasingly seen the FSA using its full armoury of rules and powers to regulate both individuals and corporate entities.
The FSA can bring actions for breaches of the FSA Handbook and for the civil offence of market abuse via their own disciplinary processes which can ultimately see cases being adjudicated before the Regulatory Decisions Committee (“RDC”) and Upper Tribunal (formerly the Financial Services and Markets Tribunal). The FSA also has prosecuting powers for the criminal offences of insider dealing and market manipulation.
Our team is perfectly placed to deal with whatever route the FSA may choose given our strong grounding in defending and advising in large-scale, high-profile criminal fraud investigations. Equally, we also regularly advise individuals who are being pursued by the FSA for market abuse through the civil enforcement regime.
The FSA’s powers on enforcement are extensive and we can assist at every stage of the process; whether in relation to dealing with compulsory requests for information and documents or advising an individual who attends an FSA interview under compulsion or caution.
Whatever the issue, our team has experience in dealing with the full gamut of powers available to the FSA.
