Advice on trustee investment planning

Many people take on the role of a trustee without having any knowledge of the responsibilities attached to the position.

This applies to not only to trustees of individual and personal trusts and lay trustees but also to many trustees of charities and charitable organisations.

The Trustee Act 2000 imposes a number of responsibilities on all trustees and these include the following duties:

  • to ensure that investments are suitable
  • to take account of the settlor's wishes
  • to ensure fairness between beneficiaries
  • to monitor investments
  • not to hoard cash
  • to take account of tax requirements

For the majority of trusts one of the easiest ways of ensuring compliance with the Trustee Act 2000 requirements is to take advice from professionals who specialise in trust investment.
