Child Abduction to the UK

What can I do if my child has been abducted to the UK?

The Hague Convention on civil aspects and child abduction and Brussels II Revised, along with various protocols between the UK and other countries, provide reciprocal procedures to those outlined in the section child abduction from the UK

If a child has been abducted to the UK, an urgent application can be made to the English court for the prompt return of the child to his or her home state.

The starting principle is that a child should be returned to his or her home country, unless special circumstances apply.  The extent to which the court will conduct a detailed analysis into the welfare of the child depends from which country the child has been removed, and so which law applies, however it is only in rare circumstances that a return is not ordered.

Child Abduction Legal Aid

If the child has been removed from a country which is a signatory to the Hague Convention or Brussels II revised, the left behind parent will be funded through the legal aid scheme.
