The courts recognise that incidences of domestic violence do not just occur in a relationship between a man and a woman. 

Same sex relationships can also be abusive.  Such abuse does not need to be physical, but can include emotional and psychological abuse, including in relation to their sexuality. As a result, the protection available to a husband or wife who finds themselves in an abusive relationship is also available to civil partners.  This includes the two main types of injunctions:

  • a non-molestation injunction which prohibits a person from threatening or demonstrating violent or intimidating / pestering behaviour
  • an occupation order, which regulates occupation of the family home
