Financial claims upon dissolution of a civil partnership
Gay partners who have entered into a civil partnership are entitled to the same range of financial orders on their relationship breakdown as those available to married couples going through a divorce.
They include:
- payment of a lump sum – an order that one civil partner pays to the other a lump sum or series of lump sums
- sale or transfer of a property – an order that property (usually the family home but can include all forms of property including shares, cars etc) be transferred from one civil partner to the other or from joint names into the sole name of one civil partner or the other. The Court can also order the property to be sold and decide how the proceeds of sale are to be divided
- payment of maintenance for the benefit of the civil partner – an order that one partner pays to the other maintenance. This can be for a period of joint lives or for a fixed term
- pension sharing – an order that one or more of a partner’s pensions be divided with part of the pension being transferred into a pension fund for the other civil partner
- child maintenance – regular payments from one partner to the other who has care of a child of the family for the child’s benefit. This can include provision for school fees
