Civil partnerships: Children conceived via assisted reproduction
The Human Fertilisation and Embryology Act 2008 extended the parenthood rules which apply to heterosexual couples using assisted reproduction to apply to gay couples.
For children conceived after 6 April 2009, if the couple are civil partners at the time of conception the non-birth mother will automatically be treated as the child’s second legal parent (unless she did not consent). If the couple are not civil partners, the non-birth mother will only be the child’s second legal parent if the couple conceives at a licensed clinic in the UK and the relevant consent forms are properly completed and signed.
