Dissolving your civil partnership

As with a divorce it is necessary to prove that the civil partnership has irretrievably broken down.

Irretrievable breakdown can be established by proving one of four facts as follows:

  • your partner has behaved in such a manner that you cannot reasonably be expected to live with them (‘unreasonable behaviour’)
  • you have lived apart for 2 years and you both agree to ending the civil partnership
  • you have lived apart for 5 years or more whereupon the civil partnership can be ended whether your partner agrees to it or not
  • your partner has deserted you for a period of 2 years or more.

A civil partnership cannot be dissolved on the basis that your partner has committed adultery. The above four facts apply in exactly the same way as they do to divorce.
