You may not be aware that without independent legal advice, a termination agreement is not worth the paper it is written on as far as your employer is concerned, as it does not prevent you from bringing a claim against your employer for unfair dismissal or discrimination.  This is why many employers ask employees to sign a compromise agreement which involves taking independent legal advice, and often pay for the cost of that legal advice, so that they can draw a line under any potential employment claims which you may have.

We regularly negotiate and advise on compromise agreements for our clients, whether to resolve a dispute with their employer, or to settle an employment tribunal claim, or to achieve an amicable resolution in circumstances where either the employer or the employee wishes to terminate employment.

Some of the compromise agreements on which we advise are very straightforward.  The employer makes a termination payment in order to settle a potential claim and both parties go away happy.  Other agreements are more complicated and may involve the resolution of an outstanding shareholding or share options, restrictive covenants, tax indemnities, confidentiality issues, and the offer of a reference.    Whatever the agreement, we have the experience to advise you and, if necessary, to negotiate on your behalf, in order to achieve the best possible outcome.
