The Dispute Resolution team includes a number of solicitors who specialise in advising on and acting in judicial review proceedings.
The team has wide experience in representing both regulators of industries and bodies which issue or defend proceedings against regulators. Our team of specialist solicitors has advised regulators on their own internal procedures and prosecutions, and has also acted for numerous defendants such as care home owners in defending proceedings brought by the Commission for Social Care Inspection before the Care Standards Tribunal. We also work closely with the firm's Regulatory department, thus ensuring all relevant skills are brought together for the benefit of clients.
Our Guidance Note on Judicial Review proceedings, which summarises the key issues in this area, is available to download.
Our experience
Recent cases have involved:
- acting for one of the largest privately owned property companies in the UK in highly contentious and important judicial review proceedings against a local authority. The application related to a challenge against a Traffic Regulation order made by the local council which would detrimentally impact on a rental park owned by our client. We successfully obtained a decision against the odds and in difficult circumstances in favour of our client (now reported in Derwent Holdings Ltd v Liverpool City Council)
- acting in leading and reported cases including Grubb v Pricewaterhouse Coopers & Nottinghamshire County Council and R (on the application of Leonard Kelsall and others) v Secretary of State for Environment, Food and Rural Affairs
- acting for mink fur farmers in a challenge to the government scheme compensating them for their loss of livelihood following the banning of the mink farming industry in the UK
