Insurance Disputes

Insurance coverage disputes arise where an insurer declines to meet a claim submitted under a policy. Cover can be declined for many reasons, those most commonly arising being issues in relation to:

  • policy interpretation and reliance on exclusion clauses
  • misrepresentation and non-disclosure
  • breach of condition(s) precedent
  • breach of warranty
  • where fraud is alleged

Our Insurance Disputes team acts for policy holders in claims against insurers and has extensive experience in all types of disputes. We can advise in relation to both commercial and personal lines insurance and have particular experience where disputes arise in relation to:

  • property insurance
  • combined all risks cover
  • jewellers block policies
  • critical illness cover
  • income protection cover

We work closely with brokers and loss assessors and can offer assistance not only in relation to court proceedings but also the initial stages of a claim including policy appeals, alternative dispute resolution and matters before the Financial Ombudsman Service.
