We can advise you in applying for an injunction or defending an application against you. As injunctions are an emergency and discretionary remedy, this is a specialist area and the rules are complex and must be followed strictly.
An injunction is a court order banning certain acts or, occasionally, instructing a party to carry out certain acts. If you are in dispute you may need the urgent remedy that an injunction will provide. If an injunction is granted, the position between the parties will be preserved until their respective rights can be determined at a full trial. Although injunctions are typically applied for shortly after proceedings have been commenced, in rare circumstances, an injunction can be sought before proceedings have commenced.

We have wide ranging experience of successfully obtaining injunctions granted to:
- freeze bank accounts and other assets. A freezing injunction is an order preventing a party from disposing of assets before trial and in particular from removing them from the jurisdiction of England and Wales. It is also possible to obtain a worldwide freezing injunction restraining a party from dealing with their assets anywhere in the world
- search and seize documents and information (which may have been illegally obtained)
- restrain publications (where false or defamatory)
- prevent infringement of copyright or other intellectual property rights
- enforcing restrictive covenants
- prevent an ongoing breach of contract
- restraining sale of land or property
Our experience
We have a long history of successfully obtaining injunctive relief at short notice and have recently obtained injunctions for clients in the following circumstances:
- acting for an online retailer of ladies clothing in obtaining an injunction restraining a competitor trading under a similar name. We successfully demonstrated that the marks and domain name used by the competitor were likely to be confused with trademarks and domain names owned and used by our client. The injuncted competitor had launched an online retail business selling the same types of products in direct competition with our client. The court ordered an injunction requiring the competitor to cease trading under the marks, to disable its website and withdraw its advertising. In an unprecedented move, we successfully argued that a likelihood of confusion could clearly be seen from Google AdWords data for the competitor's mark
- acting for a major North West telecommunications company in proceedings brought by it against individuals who had perpetrated substantial and complex mobile phone fraud against it and others. We obtained freezing injunctions, and recovered substantial sums in damages on behalf of our client
- acting for an employer against a former director who had misused and misappropriated the company's confidential and proprietary information. We obtained an order requiring the former director to deliver up the confidential information and to account for the profits generated by the misuse of that information. The former director was also prohibited from contacting our client's customers for a period of time
