We have extensive experience of acting within the public and private sectors in disputes arising from all types of outsourcing and procurement related issues.

We have acted in disputes relating to substantial outsourcing projects in such diverse sectors as transport infrastructure, IT, catering and environmental, to name a few.

Our aim is to assist our clients by providing specialist and proactive technical and legal advice, in a straightforward and cost effective way, aimed at providing an affordable and workable solution in accordance with our clients’ commercial aims.

We can particularly add value when engaged at an early stage, before litigation becomes inevitable, and we always strive to provide workable, commercial solutions rather than submitting to the uncertainties and expense of the litigation process. We add value by strategically enabling our clients to engineer an acceptable commercial solution.

We act for clients ranging from public sector bodies, private companies owned within the public sector, and private organisations. This wide ranging experience, particularly in public/private sector disputes, means we are able to understand the mindset and commercial drivers of both sides to the dispute and are therefore able to provide balanced commercial advice.

We work closely with, and our clients can therefore draw on the expertise of colleagues in, all other relevant specialisms, particularly intellectual property, information technology, public sector, commercial and employment.

Our recent expertise includes the following:

  • acting for a private sector bidder in relation to a substantial local authority procurement for a water aeration solution for a canal basin. We succeeded in persuading the Council to abandon the flawed procurement and restart the process in an appropriate fashion
  • acting for a private sector company wholly owned by the public sector in a substantial dispute with its outsourced catering supplier. The dispute involved determining the best way to terminate an outsourced project halfway through its term, with the least commercial risk to the client
  • acting for a major private sector retail company in a dispute over substantial outsourced IT project
  • acting for a major UK plc in a substantial IT project dispute, involving issues of poor quality of service, lack of fitness for purpose of project materials and other breaches of contract. The matter settled on advantageous commercial terms for our client
