Patents are a valuable, exploitable commodity.  We advise and assist clients who discover that a competitor or third party is infringing their patent or who threaten the validity or enforceability of the patent.

By way of example, in the reported case of Ultraframe (UK) Limited v (1) Eurocell Building Plastics Limited (2) Eurocell Profiles Limited [2006] EWHC 1344 (Pat), 9 June 2006, we acted for the claimant on the assessment of the damages due to it following a successful patent and design right infringement action brought by the claimant against a competitor.  Our client recovered a multi-million pound sum in damages and costs.

The decision is important because it provides an illustration of a careful analysis of most of the heads of damage that might arise in a patent infringement claim. The decision also shows how the courts may recognise and deal with the additional damage caused by an infringer who was, up to the commencement of the infringement, a major distributor of the patent owner's products, and who deliberately set out to capture that market by making an interchangeable product and pricing it aggressively.
