Pannone has advised a range of public sector bodies on public procurement and state aid issues.
In particular, we have advised on the structuring of public procurements for a number of major projects including tram system operating agreements, IT projects, construction projects and development agreements. This work has included providing advice on the preparation of OJEU notices, pre-qualification questionnaires and invitations to negotiate or to submit outline proposals, pre-qualification and on bid evaluation procedures and compliance with applicable public procurement rules. Where relevant, we have also provided advice on state aid implications of public procurements, including in the context of redevelopment schemes, and the exemptions that are available to enable much needed public sector investment in infrastructure to take place.
We have also advised public sector bodies where claims are made that public procurement procedures have not been followed and we are very conscious of the growing incidence of public procurement challenges and the difficulties public sector bodies will face in ensuring the new standstill rules are followed and that procurement procedures are not disrupted by disappointed bidders.
We have recently provided a number of workshops to client authorities on the new remedies rules and the practical implications for their bid evaluation and debrief procedures.
