We have a great deal of experience working with Commercial Finance and Banking clients in relation to the Regulation of Consumer Credit and the possible criminal, civil and disciplinary issues which may arise as a result of litigation by a party to an agreement, enquiries from the Office of Fair Trade ("The OFT") and/or the Ombudsman.
More specifically our work will include:
- advice of regulatory matters and enforcement by the OFT and Ombudsman
- dealing with the impact of Default under Regulated Agreements
- allegations of unfair relationships and unfair practises and the scope of the OFT to intervene
- applications for Licences and ‘Fitness’ issues
- licensing and the consequences of an individual or corporate entity not being licensed
- any resultant civil litigation and penalties arising from an action by a debtor or by the OFT
- appeals
- action by the Ombudsman
Our role may include liaising with the OFT and making representations to the regulator where appropriate in order to achieve a satisfactory result for our clients, and in the event that such an approach does not achieve the required result to thereafter defend our client’s interests.
