Practice Area

Dan is a Legal Director in Dispute Resolution and Head of Pannone’s Franchising team. He has considerable experience acting in large value and complex contractual disputes and acting, predominantly for claimants, in professional negligence claims against valuers and solicitors. He also advises regularly in respect of issues arising from the breakdown of business relationships such as breach of fiduciary claims against directors, claims brought by minority shareholders and partnership disputes. More recently he has widened his experience to include contractual disputes with a sports law focus. 
 
Dan’s clients range from private individuals to companies with multi million pound turnovers. He has acted for a number of financial institutions and recently was part of the team advising one of the country's most high profile football agents in his dispute with his former employer. He has considerable trial experience but is, first and foremost, a commercial lawyer and recognises that clients’ main drivers are the early and commercial resolution of their disputes. Dan uses all forms of ADR, where appropriate, to achieve those objectives.
 
Best career moment: There have been a number of high points but the most recent was acting for a firm of solicitors in a professional negligence claim brought by a former client. Although the claim was significant it was below the solicitors’ insurance excess so any damages would have to have been paid by them personally. The claimant had the benefit of after the event insurance and his solicitors were acting pursuant to a conditional fee agreement - this raised the stakes and coloured the claimant’s approach to the litigation as he thought he was "bomb proof". Ultimately, and with the benefit of Paul Chaisty QC`s pugnacious advocacy, the trial Judge accepted my clients’ position, disbelieved the claimant’s evidence and awarded only nominal damages but ordered the claimant to pay my clients' costs.

Notable cases include

  • acting for a Panamanian company on a claim for £1.7m arising out of the administrative receivership of Karrimor International Limited and the liquidation of Cullinan UK Limited
  • acting for a French national in a claim for circa £9m brought by one of the world`s leading service providers in the pharmaceutical and healthcare markets
  • acting for a national publisher of revision and study aids in proceedings brought against it by 76 claimants arising from its closure of a caravan park
  • acting for the Nationwide Building Society in the managed litigation brought against solicitors and valuers for professional negligence which proceeded through the High Court in the late 1990s
  • acting for an international franchisor in respect of a number of disputes involving breach of contract and the protection of the clients intellectual property rights
