A top travel law lawyer has expressed his concern for elderly travellers abroad after three people have died and eleven others have contracted legionnaires’ disease.
They were staying at the AR Diamante beach Hotel in Calpe on Spain’s Costa Blanca and the cause of the outbreak is currently being investigated. All three were in their seventies and were on holiday with specialist tour operator Saga."
Paul McClorry a partner at Manchester law firm, Pannone, said, “The elderly are particularly vulnerable to the legionella bacteria which is most commonly found in air-conditioning systems, cooling towers, hot water condensers and spa pools. My sympathy goes out to the families of the three holidaymakers who have died and the other eleven affected. Legionnaires’ disease is a deadly condition and immediate diagnosis is often crucial to survival.”
He added, “When the families of the deceased and those others affected return to the UK and have time to consider their position, they should certainly ask questions of the tour operator as to the health and safety standards of the hotel. Legal advice should be sought. Legionnaires’ disease cases can be difficult to prove but they can and should be actioned if there was negligence. Having acted successfully for a 68 year old man who contracted legionnaires’ disease whilst on holiday in Hurghada, Egypt, I know how hard these cases are to prove but I would urge those who have been affected to consider their legal rights.”
