Kim Harrison recently posted a blog discussing a new £300 million scheme which will see the Government forcing insurers to pay into a central pot to be used to compensate victims of asbestos related mesothelioma whose employers have gone out of business or whose insurers cannot be traced.
Kim Harrison recently posted a blog discussing a new £300 million scheme which will see the Government forcing insurers to pay into a central pot to be used to compensate victims of asbestos related mesothelioma whose employers have gone out of business or whose insurers cannot be traced.
A major drawback of the scheme is that the scheme will only help victims who suffer from mesothelioma as it excludes compensation for other asbestos related diseases such as lung cancer, asbestosis, pleural thickening and pleural plaques. Also, it won’t be backdated so will only help those diagnosed with mesothelioma after the scheme comes into force.
In addition to this; as Pannone partner Patrick Walsh pointed out in a recent article "at the moment if you die during the process of a claim, your dependents can receive the compensation, but it has not been decided if this new scheme will apply to dependants. It looks like, if the individual dies before the claim is processed, the claim dies with them”. He also added that “the limited few who are entitled to make a claim, assuming they survive long enough to see it through, are likely to receive between £80,000 and £100,000 – less than they would get if they went through the courts”.
