It is not unusual following a divorce or separation for parents to disagree on how their child should be brought up. These problems can be greater where, as for TomKat, the parents cultural or religious backgrounds are different.

In England the right to be involved in decisions concerning a child’s upbringing comes from having parental responsibility which most parents have automatically or can acquire. If those with parental responsibility can’t agree on what arrangements for a child are best then the court will ultimately have to decide.

This can include which school a child should attend, their religious upbringing, whether medical treatment is appropriate and even before they are 18 whether they should be allowed to marry.
