About care home claims

Where an individual has been abused in a local authority care home, the claim will usually be brought against the local authority. In some cases however, the care home will have been run by a separate organisation or charity, even though the individual was placed at that home by the local authority. In such cases the claim will usually be brought against the organisation responsible for the home, rather than the local authority that placed the child.

About group litigation care home claims

There are cases, usually arising out of widespread abuse in a care home, where there are a number of individuals who wish to bring claims.

Where a number of claims are brought at the same time the court will often order that the claims be dealt with by way of group litigation. This is because there will be a number of common issues between the individual cases.
